BY ENTERING THE INVEST FEST PITCH COMPETITION FOR THE NIPSEY HUSSLE BUSINESS GRANT (THE “INVEST FEST COMPETITION”) PARTICIPANT (“PARTICIPANT”) AGREES TO ABIDE BY THESE OFFICIAL COMPETITION RULES AND DISCLAIMERS AND THE DECISIONS OF INVEST FEST, LLC, EARN YOUR LEISURE, LLC AND THE ADDITIONAL SPONSORS (THE “SPONSORS”), INCLUDING INDEMNITIES AND LIMITATIONS OF YOUR RIGHTS AND REMEDIES.

Rules

Invest Fest Competition is open solely to participants who are 18 years of age or older at the time of entry. This Contest is subject to all applicable federal, state and local laws. Participants are limited to one entry. Sponsor and Administrator’s employees, officers, directors and other related parties, and their respective immediate families, are not eligible to participate.  The Sponsors reserve the right, in their sole discretion, to cancel, suspend, or terminate the Invest Fest Competition for any reason and without prior notice to any participant. Any taxes resulting from acceptance of any prize are the responsibility of the winner. The Winner of this Contest must be in compliance with these eligibility requirements to collect their prize. Any participants found to be outside of these conditions shall be deemed disqualified.

Sponsor reserves the right to verify the eligibility of all entrants. Illegible and/or incomplete entries, and entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Sponsor and its agents are not responsible for lost, late, stolen, damaged, incomplete, invalid, unintelligible, garbled, delayed or misdirected entries, for technical failures of any kind, or any human error which may occur in the receipt or processing of entries. All entries become the sole property of the Sponsor and will not be acknowledged or returned. The odds of winning the Contest are dependent on the number of entries by all participants.

If a tie the judges can ask questions that dive deeper into aspects not fully covered in the initial pitch, such as scalability, market strategy, or team dynamics to then determine a final winner.

How to Enter

Participants must create an Instagram video explaining their business and how $100,000 can help their business, tagging @investfestival, @themarathonclothing, and @earnyourleisure. Participants may enter by purchasing a ticket to Invest Fest and completing the entry form at investfeststage.fourblend.app/pitchcompetition.

NO PURCHASE OF ANY PRODUCT OR SERVICE IS REQUIRED TO ENTER OR PARTICIPATE IN THIS PROMOTIONAL GAME.  An alternative method of entry is available to participants who do not wish to purchase a ticket to Invest Fest. Participants wishing to do this must create an Instagram video with the required tags and mail in a printed copy of an entry form on an eight by ten (8.5×11) sheet of paper to the Earn Your Leisure, LLC address above in a No. 10 (#10) envelope also containing a four by six postcard with the participant’s hand-written first and last name, business name, and job title. Mailed entries must be postmarked no later than August 10, 2024. MAILED ENTRIES MUST BE HANDWRITTEN. PURCHASE OF THE SPONSOR’S PRODUCTS OR SERVICES WILL NOT INCREASE YOUR ODDS OF WINNING.

Cards or envelopes that are not handwritten, that utilize address labels or stickers (for any address), that are photocopied, hand-stamped, computer-generated or otherwise mechanically or digitally produced or reproduced, or that otherwise fail to comply with these Official Rules will NOT be honored, acknowledged or returned, and the persons submitting such requests will not receive an entry.  Envelopes containing multiple cards will NOT be honored, acknowledged or returned, and the persons submitting such requests will not receive an entry.

Contest Period

Submissions will be accepted between June 3^rd, 2024 and August 10, 2024 at 11:59 p.m. (E.S.T) ((the “Contest Period”). Participants may enter at any time within the Contest Period unless otherwise noted above. 150 participants (100 preselected and the first 50 walk-ins) will be chosen to pitch in person on August 23, 2024 at Invest Fest. Each participant must present a one-minute live pitch in front of judges with a one-minute visual presentation. Three finalists will be chosen from the 100 participants pre-selected. One finalist shall be chosen from the first 50 walk-ins. The four finalists of the first round will then present live on the main stage on August 24^th.

Each finalist will present a visual presentation under three minutes for display on the stage screen. Following each presentation, judges will give feedback and score the participant individually. Score cards will be tallied at the end. The finalist with the highest score (the “Winner”) will be awarded a $100,000.00 symbolic check on stage and will receive $100,000 via wire within the following 7-10 business days. The Sponsors reserve the right to verify eligibility of the Winner. All applicable taxes, tariffs and fees are the sole responsibility of the Winner. The Winner may be issued a 1099 tax form for the approximate retail value of the Prize. The Sponsors reserve the right to verify eligibility of a Winner.

Participant agrees to comply with all applicable venue regulations in connection with Invest Fest. The venue and Sponsors reserve the right to remove or to deny entry to any Participant who engages in an illegal or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the event or participating in the Invest Fest Competition. The Released Parties (defined below) will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any event.  Event tickets may not be resold or offered for resale. Any such resale may result in disqualification and Prize forfeiture, and may invalidate the license granted by the event tickets or passes.

Warranties

The Prize(s) are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including without limitation, any implied warranty of merchantability or fitness for a particular purpose). Acceptance, participation in and/or use of the Prizes are at the Winners’ sole risk and Sponsor is not responsible for damages whatsoever, including special, indirect, or consequential damages, arising out of or in connection with the use and/or misuse of any of the Prize. Sponsor reserves the right to verify eligibility of a Winner.

By entering the Invest Fest Competition, Participant warrants as follows: (1) that he, she, or it fully owns the information it submits in connection with the Invest Fest Competition and can make such submissions without violating any applicable law or agreement with a third party, and (2) that any information or material provided is true and correct.

RELEASE

All decisions of Sponsor are final and binding; and entrants agree to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law.

By entering the Invest Fest Competition, Participant agrees to release, discharge, and hold harmless the Sponsors, along with the Sponsors’ employees, officers, directors, affiliates, agents, and assigns (the “Released Parties”), from and against any claim, demand, liability cause of action, loss, injury, cost, expense, fee, or penalty, relating to or arising from Participant’s participation in the Invest Fest Competition. Participant acknowledges and agrees that all disputes, causes of action, and claims arising from the Invest Fest Competition shall be resolved solely on an individual basis, and exclusively by the state or federal courts situated in Georgia, and that the laws of Georgia shall govern, without regard to its conflict of laws principles. Participant waives any right to a trial by jury. The Contest is void outside the US and where prohibited or restricted by law, and subject to applicable federal, state, and local laws.

The Released Parties shall not be liable for: (a) late, lost, delayed, stolen, misdirected, postage due, incomplete, unreadable, inaccurate, garbled or unintelligible entries or communications, regardless of the method of transmission; computer hardware, software or other internet, technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (c) data corruption, theft, destruction, unauthorized access to or alteration of entries or other materials; (d) any injuries, losses or damages of any kind caused by the Prize or resulting from acceptance, possession or use of a Prize, or from participation in the Contest; or (e) any printing, typographical, administrative or technological errors in any materials associated with the Invest Fest Competition.

IN NO EVENT WILL THE SPONSOR PARTIES BE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF PARTICIPANT’S PARTICIPATION IN THE INVEST FEST COMPETITION, THESE RULES, AND/OR ANY PARTICIPANT’S RECEIPT, USE, OR MISUSE OF A PRIZE. THE SPONSORS’ ENTIRE LIABILITY WITH RESPECT TO PARTICIPANT’S PARTICIPATION IN THE INVEST FEST COMPETITION, THESE RULES, AND/OR ANY PARTICIPANT’S RECEIPT, USE, OR MISUSE OF A PRIZE SHALL BE LIMITED TO THE INVEST FEST TICKET FEE. 

The Sponsors shall have the irrevocable and transferable right and license to collect, use, and distribute any data or information provided by Participant to promote the Invest Fest Competition, its business, brand, products, and/or services, in any and all media at any time. Sponsor reserves the right to use the Invest Fest Competition for publicity purposes in any media and to use the name, likeness, and hometown name and/or Prize information of selected participants as part of that publicity, without any compensation or prior review unless prohibited by law.

Privacy Policy

In order to participate in the Invest Fest Competition, participants will be required and requested to supply certain information about themselves. Sponsors have specified which information is mandatory in order to participate in the Contest. Any information provided to Sponsors will be used by Sponsors for the purposes of administering the Invest Fest Competition and for marketing purposes, but will not be sold or rented to third parties. In addition, personal information may be used by Sponsors to contact you after the Invest Fest Competition is over to provide you with information about Sponsors and their activities and other promotions.
